Sydney law firm, Watts McCray, has warned that failure to get a divorce can have serious financial effects. Super entitlements are paid to the legal spouse after the death of a member, regardless of the nomination of another beneficiary. A binding nomination can overcome this issue. Couples should change their joint ownership of a home from joint tenants to tenants in common so that they have control of their half-interest in the property.
