ABIX Summary
The administration of estates is a complex matter. It involves obtaining probate, getting in the estate, preserving it from waste, paying the debts due by the estate, and distributing the residue. Estates administration mistakes account for a large number of negligence claims against solicitors acting in the wills and estates area. The most common problems are: wills misread or misinterpreted; problems with sale of shares; problems with long-running estates; premature distribution; and executors acting in a conflict of interest.
